Indisputable facts

The DOJ suppressed 7,000 pages of exculpatory evidence demonstrating McDuff's innocence.  McDuff learned of this illegal act only after the government's attorney for the Securities and Exchange Commission (SEC), under threat of court order, provided McDuff with the evidence four years into his 25 year prison sentence.  Sound familiar?  It happened to Senator Stevens. It happened to Cliven Bundy.  It happened to Scooter Libby.

The Washington, D.C. SEC Administrative Law Judge (ALJ) held an administrative hearing at the prison housing McDuff in 2016.  In the government's attempt at overkill, the SEC, was ordered by the court to expose the fraud perpetrated by another government agency, the DOJ.  Sound familiar?  It happened to Senator Stevens. It happened to Cliven Bundy.  It happened to Scooter Libby.

The DOJ prosecuted an innocent McDuff, and cheated in order to do it.  The 7,000 pages of evidence proved his innocence and proved the DOJ maliciously and knowingly prosecuted an innocent man.

The Gary McDuff case in its court filings demonstrate a manifest need for legislation to curb and hold responsible abusive prosecutions and rogue prosecutors.  The court filings, below, evidence DOJ corruption on a scale rarely seen.

The Habeas Corpus Petition was assigned on June 6, 2017 to Federal District Judge, the Honorable Richard A. Schell and his Magistrate Judge Kimberly C. Priest-Johnson.  McDuff's Brief ("Source Brief") and Appendices filed with the Court are available to view and download here.

WHAT HAPPENED TO GARY McDUFF?

The trial court in McDuff's case demonstrated indisputable bias by pronouncing him guilty and sentencing him 3 years prior to trial and two years before arraignment!  Attorneys familiar with McDuff's case agree that his prosecution may be worse than the unlawful prosecutions of Senator Ted Stevens, Cliven Bundy, and Scooter Libby, which exposed the systemic dishonesty and prosecutorial misconduct of the Department of Justice (DOJ).  This systemic dysfunction is front and center in the McDuff case.
